Denver: Yet another assault at the hands of the Denver police

…but this time, it’s a whole family that was attacked… inside their home.

DENVER — A Denver family has filed a lawsuit against the Denver police department after they say officers barged into their home without a warrant and beat up three members of their families.

According to the lawsuit, police were investigating allegations of drugs and prostitution at the home.  But police didn’t find the people who allegedly committed those crimes; instead, they found the Martinez family, who say police beat them first and asked questions later.

According to family members, police began pounding on the door of their home on Stuart St. at 11:00 p.m., so the father cracked the door open.

They say that’s when police barged in and started throwing punches.

Jonathon Martinez was 16 years old at the time of the incident, and he says an officer “pulled me back and then pushed my head through the window.”

Jonathon’s older brother Daniel tells FOX31 News that another police officer grabbed him in a head lock.  “He took me outside slammed me on the concrete,” he said.

21-year-old Nathan Martinez says a third officer punched him in the face.

The father and his 3 sons were all arrested and charged with resisting arrest and assaulting a peace officer.

The family took the cases to court and the charges were dismissed.

“These police officers barged in.  They had no warrant, they had no consent,” said David Lane, the family’s attorney.  “Every single one of these kids was exonerated.  Their dad was exonerated.”

“Just because allegations are made doesn’t mean something happened,” said Denver Police Lt. Mathew Murray.

Murray says an internal affair investigation exonerated the officers of any wrong doing. The independent police monitor reviewed the case and agreed.

“The officers were exonerated, and exonerated is the highest level an officer can get,” Murray said.  “In other words, the investigation showed the allegations did not occur.”

The officers maintained the family allowed them into their home, but the Martinez family disagrees.

The internal affairs investigation reported conflicting statements were made by the Martinez family and therefore exonerated the officers.
